Символьне означення української державності у хронотопі історії Східної Європи

Abstract

Державна символіка є ключовим елементом відображення історичної тяглості та основою формування новітньої системи символьного означення суспільного розвитку. З трьох символів державності, визначених Конституцією України правове оформлення отримав тільки Державний Гімн України. Інші символи — Державний Прапор України і Державний Герб України не отримали юридичного визнання та закріплення Законом України відповідно до вимог Конституції України. Така невизначеність свідчить про існуючу у суспільстві культурологічну кризу виражену у протиставленні культурних цінностей базованих на радянських і російських традиціях та споконвічних національних устремлінь до незалеж- ності. Проблема дуалізму Державного Герба України, попри періодичні спроби її вирішення, стає неактуальною на фоні усталення малого Державного Герба України. Постає питання законодавчого врегулювання конституційної норми про Державний Герб України або шляхом правового утвердження існуючої норми або шляхом переходу до усталеного за роки незалежності єдиного герба — Тризубу.

State symbols are a key element of the re ection of historical longevity and the basis for the formation of the latest system of symbolic de nition of social development. Of the three symbols of statehood de ned by the Constitution of Ukraine, only the National Anthem of Ukraine received legal registration. Other symbols — the State Flag of Ukraine and the State Emblem of Ukraine have not received legal recognition and enshrined in the Law of Ukraine in accordance with the requirements of the Constitution of Ukraine. Such uncertainty testi es to the existing cultural crisis in society, expressed in the opposition of cultural values based on Soviet and Russian traditions and the original national aspira- tions for independence. e problem of dualism of the State Emblem of Ukraine, despite periodic attempts to solve it, becomes irrelevant against the background of the establish- ment of a small State Emblem of Ukraine. e question arises of legislative regulation of the constitutional norm on the State Emblem of Ukraine either by legal approval of the existing norm or by transition to the single coat of arms established during the years of independence — the Trident.
