Застосування правил Інкотермс 2020 на ринку зернової продукції

Abstract

В статті проаналізовані особливості нової редакції Інкотермс 2020, які рекомендовані до імплементації до зовнішньоекономічних договорів з 1 січня 2020 року та вплив таких змін на ринок зернової продукції. Автори показують ситуацію із використанням на ринку зернової продукції діючих Правил Інкотермс, наводять зміни в Правилах порівняно Інкотермс 2010 та Інкотермс 2020 та звертають увагу на те, які саме угоди слід переглянути трейдерам на ринку зерна, щоб їх договори відповідали сучасним вимогам. Оскільки на різних підприємствах складається різна практика укладання зовнішньоекономічних договорів на ринку зернової продукції на основі Правил Інкотермс авторами проаналізовано ряд підприємств та проведено інтерв’ю експертів з питань експорту, внаслідок чого було встановлено кілька особливостей таких договорів. Правила Інкотермс та їх сучасні удосконалення у редакції Інкотермс 2020 є гарним інструментом для удосконалення ринку, формування механізмів стабільної роботи, постійної роботи виробників та торговців.

В статье проанализированы особенности новой редакции Инкотермс 2020, которые рекомендованы к имплементации к внешнеэкономическим договорам с 1 января 2020 года и влияние таких изменений на рынок зерновой продукции. Авторы показывают ситуацию с использованием на рынке зерновой продукции в действующих Правил Инкотермс, приводят изменения в Правилах по сравнению Инкотермс 2010 и Инкотермс 2020 и обращают внимание на то, какие именно сделки следует пересмотреть трейдерам на рынке зерна, чтобы их договоры соответствовали современным требованиям. Поскольку на различных предприятиях складывается разная практика заключения внешнеэкономических договоров на рынке зерновой продукции на основе Правил Инкотермс авторами проанализирован ряд предприятий и проведения интервью экспертов по вопросам экспорта, в результате чего было установлено несколько особенностей таких договоров. Правила Инкотермс и их современные усовершенствования в редакции Инкотермс 2020 является хорошим инструментом для совершенствования рынка, формирование механизмов стабильной работы, постоянной работы производителей и торговцев.

The article analyzes the features of the new edition of Incoterms 2020, which are recommended for implementation to foreign economic agreements from January 1, 2020, and the impact of such changes on the grain market. Specific questions about the grain market arise about the identification of quality, coolness, various indicators, humidity, content of pollution, etc. Together, this has a significant impact on the order of cost sharing between buyer and seller, as well as determining the fact of delivery of products of appropriate quality. Unlike other markets where the quality of produce does not change significantly over the course of preparation for delivery or transportation, in the grain market, quality and conformity issues are a major risk that may have already shipped the shipment into a waste that will not be paid by the buyer. Incoterms establish rules governing the delivery of goods from seller to buyer. This includes transportation, responsibility for export and import clearance of goods. These rules define the person responsible for payment for delivery, customs clearance, and insurance of risks on the way of transportation of goods, depending on the specified standard terms of delivery. The authors illustrate the situation with the use of the Incoterms Regulations in the grain market, make changes to the Regulations in comparison to Incoterms 2010 and Incoterms 2020 and draw attention to which agreements should be reviewed by traders in the grain market in order for their contracts to meet current requirements. Because different companies have different practices of concluding foreign trade contracts in the grain market based on Incoterms rules, the authors analyzed a number of companies and interviewed export experts, which revealed several features of such contracts. Companies can start using Incoterms 2020 for contracts concluded before January 1, 2020. If the parties agree on Incoterms 2020 in the contract, then such rules will apply to them. Expert environment expects full transition to Incoterms 2020 for most Incoterms contracts within 12-18 months. The Incoterms Rules and their current improvements in the Incoterms 2020 edition are a good tool for improving the market, forming mechanisms for stable operation, the constant work of manufacturers and traders.
