Відповідальність за кримінальне правопорушення «жорстоке поводження з тваринами» (ст. 299 КК України): розгляд судової практики

Abstract

Україна, зокрема вітчизняний законодавець, за останні декілька років стрімко виконує умови Угоди про асоціацію України з Європейським Союзом, переглядаючи, розробляючи та затверджуючи нормативно-правові акти в різних сферах суспільного життя. Хвиля змін у кримінальному законодавстві України торкнулась і законодавства щодо захисту тварин. Були внесені зміни та доповнення до Закону України «Про захист тварин від жорстокого поводження» від 21.02.2006 № 3447-IV, розроблений новий Закон України «Про ветеринарну медицину» від 04.02.2021 № 1206-IX (введення в дію відбудеться 21.03.2023), внесені зміни в статті Кодексу України про адміністративні правопорушення (далі – КУпАП) та Кримінального кодексу України (далі – КК України). Але зоозахисники вважають, якщо не популяризувати гуманного ставлення до тварин, не розвивати правову культуру серез громадян та не активізувати роботу правоохоронців у цій сфері, таких змін виявиться замало. Адже правова культура є важливим ідеологічним засобом в утвердженні правових цінностей у сучасному просторі, який здійснює активний вплив на свідомість людей.Все частіше трапляються випадки жорстокого поводження з тваринами, але вироки про притягнення до відповідальності винних осіб є поодинокі.

Ukraine, in particular the domestic legislator, over the past couple of years has been rapidly fulfilling the terms of the Association Agreement between Ukraine and the European Union, reviewing, developing and approving regulations in various spheres of public life. The wave of changes in the criminal legislation of Ukraine also affected the legislation on animal protection. Amendments and additions were made to the Law of Ukraine «On Protection of Animals from Cruelty» dated 21.02.2006 № 3447-IV, a new Law of Ukraine «On Veterinary Medicine» dated 04.02.2021 № 1206-IX was developed (becoming valid 21.03.2023), amendments were made to the article of the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine. The author considers the case law on bringing the perpetrators to justice for a criminal offense, the composition of which is provided in the disposition of Article 299 of the Criminal Code of Ukraine «Animal cruelty». Attention is focused on the fact that in most of the offenses the perpetrators have the opportunity to avoid criminal liability, which in many cases the author considers unfair. Such data show that there are some difficulties in the process of bringing the perpetrators to justice, namely there is a problem in obtaining evidence, the desire of witnesses to testify, the ineffectiveness of law enforcement agencies and other negative factors. The article considers court decisions on bringing a guilty person to justice for cruelty to animals and ways to investigate such a criminal offense.
