Моніторинг парламентською асамблеєю Ради Європи запровадження в Україні міжнародних стандартів прав людини як виконання зобов’язань перед Радою Європи (1995–2012 роки) та його ефективність

Abstract

Здійснений історико-правовий аналіз предмета і наслідків моніторингу виконання зобов’язань України перед Радою Європи, які (зобов’язання) під час вступу в цю організацію Україна брала на себе у сфері забезпечення прав людини. Здійснений аналіз свідчить про неможливість у пострадянських країнах побудови «Європи» без участі Європи

Проведен историко-правовой анализ предмета и последствий мони- торинга выполнения Украиной обязательств перед Советом Европы, которые (обязатель- ства) Украина брала на себя при вступлении в эту организацию в сфере обеспечения прав человека. Проведенный анализ свидетельствует о невозможности в постсоветских странах построения «Европы» без участия Европы.

A historical and legal analysis was made of the subject and consequences of monitoring the fulfillment of Ukraine’s obligations to the Council of Europe, which (obligations) Ukraine took upon it self when it joined the organization in the field of human rights. It is shown that against the background of constant resistance of the Ukrainian authorities to the effective implementation of democratic “rules of the game” of the Western type, progress in this are a was achieved due to constant pressure from the Council of Europe, in particular, on the monitoring procedure from the Parliamentary Assembly of the Council of Europe, with constant reminder about the need to “play by the rules”. The course and monitoring results in the following are as are considered: abolition of the death penalty; the achievement of the independence of the judiciary from the interference of the executive branch; fight against corruption; slow process of legislative reforms (ad option of new criminal and criminal-procedural codes; new civil and civil procedure codes; new law on political parties); termination of torture; illegal interference of the authorities in the activities of mass media and pressure on journalists, etc. The analysis shows that in the post- Soviet countries it is impossible to build a “Europe” without the participation of Europe.
