Адміністративно-правове регулювання державного управління у сфері господарської діяльності в Україні

Abstract

Дисертацію присвячено дослідженню адміністративно-правового регулювання державного управління у сфері господарської діяльності в Україні. Розглянуто методологічні засади такого дослідження; виокремлено групи адміністративно-правових досліджень державного управління у сфері господарської діяльності; визначено сферу господарської діяльності як об’єкт державного управління; охарактеризовано становлення нормативно-правового забезпечення державного управління у сфері господарської діяльності; з’ясовано особливості державного управління у цій сфері; визначено основні (базові) та спеціальні принципи адміністративно-правового регулювання державного управління у сфері господарської діяльності. Окрему увагу приділено механізму такого регулювання, його елементам та адміністративно- правовому режиму у досліджуваній сфері. Визначено суб’єктів державного управління у сфері господарської діяльності. Розглянуто концептуальні засади удосконалення національного законодавства стосовно державного управління у сфері господарської діяльності, наведено конкретні пропозиції щодо внесення змін до нормативно-правових актів. Диссертация посвящена исследованию административно-правового регулирования государственного управления в сфере хозяйственной деятельности в Украине. Рассмотрены методологические основы такого исследования; выделены группы административно-правовых исследований государственного управления в сфере хозяйственной деятельности; определена сфера хозяйственной деятельности как объект государственного управления; дана характеристика становлению нормативно-правового обеспечения государственного управления в сфере хозяйственной деятельности; определены особенности государственного управления в этой сфере; основные (базовые) и специальные принципы административно-правового регулирования государственного управления в сфере хозяйственной деятельности. Особое внимание уделено механизму такого регулирования, его элементам и административно-правовому режиму в исследуемой сфере. Определены субъекты государственного управления в сфере хозяйственной деятельности. Рассмотрены концептуальные основы совершенствования национального законодательства в отношении государственного управления в сфере хозяйственной деятельности, приведены конкретные предложения о внесении изменений в нормативно-правовые акты. The dissertation is devoted to the research of administrative and legal regulation of state governance in the field of economic activity in Ukraine. The methodological bases of the specified research are considered. It is identified that the methodology of such study has multilevel system and involves the use of methods of various complexity, consistent with each other and focused on resolution of some research problems. Based on the overview of existing administrative and legal studies of state governance, it is possible to define groups of state governance studies in the field of economic activity. The field of economic activity as a state governance object is a system of certain specific interconnected relations, covered by the authoritative influence of the subjects of governance; is determined by the range of relations in respect of and within which state governance is implemented; is a set of social relations that arise, change and terminate due to: the activities of economic entities pursuing production and selling of products, execution of works or provision of services of a cost nature, with a price certainty, and management of public property. The peculiarities of state governance in the field of economic activity are clarified. It is emphasized that state governance of economic activity should be determined through the lens of the state economic function. Depending on the tasks to be performed as part of state governance of economic activity, we propose to determine the directions of administrative and legal regulation of such governance – providing implementation conditions for human and civil rights and freedoms enshrined in the Constitution of Ukraine; ensuring the implementation of state economic policy and state regulatory policy in the field of economic activity; ensuring information security in the field of economic activity. The basic and special principles of administrative and legal regulation of state governance in the field of economic activity are determined. For the complexity of administrative and legal regulation, it is considered necessary to define the special principles determined by its directions. Particular attention is paid to the mechanism of such regulation, its elements and administrative and legal regime in the study area. The conclusion was made that the administrative and legal regulation mechanism makes preconditions for state governance of economic activity. The main elements of such a mechanism are: administrative and legal provisions, administrative and legal relations, acts of interpretation and application of administrative and legal provision. The author stresses out that the effective operation of any mechanism requires proper legal awareness of the participants of the respective relations. We consider reasonable the statement that the differences in the legal regulation of state governance of economic activity depending on the type of such activity can be explained by the different statutory administrative and legal regimes. The establishment of specific administrative and legal regime in the field of economic activity is the result of the application of a certain mechanism. On the other hand, the administrative and legal regime of economic activity, which is already performed, determines required and possible mechanism of administrative and legal regulation of state governance in the field of economic activity (relations between economic entities and authorities). The author proposes to distinguish administrative and legal regimes in the field of economic activity depending on the objects of state governance in the relevant field: administrative and legal regime of economic activity and administrative and legal regime of public property in economic activity. The authorities in charge of state governance of economic activity have been identified. It was revealed that other subjects of state governance in the field of economic activity are represented by two groups: subjects whose governance functions follows from the laws of Ukraine and subjects of delegated powers. The conceptual framework for the improvement of the national legislation regarding the state governance of economic activity is considered, specific proposals to regulatory acts are provided.
