Статус мов меншин у міжнародному праві.

Abstract

Сьогодні проблема захисту мовних прав меншин є актуальною для більшості країн світу. В статті визначається поняття мовних меншин та мов меншин у міжнародному праві, розкривається природа мовних прав у міжнародному праві, статус мов меншин у конституційному законодавстві країн Європи. За своїм статусом право користуватися рідною мовою або мовою меншин, що містяться в конституціях європейських країн, можна умовно поділити на шість категорій. Розглядаються міжнародні універсальні та європейські регіональні стандарти захисту мов меншин, що склали основу для розвитку та конкретного вирiшення питання, що стосується правового статусу мов меншин у міжнародному праві. Аналізуються універсальні міжнародно-правові акти у сфері захисту мовних прав національних меншин. Основна мета яких це забезпечення міжнародної безпеки та стабільності системи для захисту меншин та їх прав, яка була створена ще під егідою Ліги Націй. Зазначена унікальна роль Європейської хартії регіональних мов або мов меншин, головною метою якої є культурний розвиток. Вона має захищати й сприяти розвиткові регіональних мов або мов меншин, що перебувають під загрозою, як європейської культурної спадщини. Першим чинним спеціальним багатостороннім вельми дієвим міжнародно-правовим документом, присвяченим захистові прав національних меншин загалом, у якому наголошується, що такий захист становить невід’ємну складову міжнародного захисту прав людинита стала Рамкова конвенція про захист національних меншин 1995 р. Також, у статті приділяється увага проблемі мовних прав і в Україні.

Summary Today the problem of protecting the linguistic rights of minorities are important for most countries. The article defines the concept of linguistic minorities and minority languages n international law, revealed the nature of language rights in international law, the status of minority languages in constitutional law in Europe. The status of the right to use their mother tongue or minority language contained in the constitutions of European countries can be divided into six categories. We consider international universal and European regional standards for the protection of minority languages, the foundation for the development and resolution of specific issues relating to the legal status of minority languages in international law. Analyzes the universal international legal instruments for the protection of the linguistic rights of national minorities. The main objective of which is to ensure the security and stability of the international system for the protection of minorities and their rights, which have been established under the auspices of the League of Nations. Said unique role of the European Charter for Regional or Minority Languages, the main aim of which is cultural development. It should protect and promote regional or minority languages under threat, as the European cultural heritage. The first current special multilateral highly effective international legal instrument devoted to the protection of minority rights in general, which states that such protection is an integral part of international protection of human lyudynyta was the Framework Convention for the Protection of National Minorities in 1995 also, the article focuses the issue of language rights in Ukraine.
